Important Information For Investors and Bond Issuers

Both the Receiver and a group of bondholders who have intervened in this action and who refer to themselves as the Bondholder Committee have each filed proposed plans for the disposition of assets of the Receivership Estate.  Copies of the proposed plans are being mailed to all investors and bond issuers and may also be viewed below.

An evidentiary hearing on the proposed plans will be held July 16, 2007, at 9:00 a.m. (EDT), before Judge John D. Tinder, in Room 215 of the Federal Building, 30 North Seventh Street, Terre Haute, IN 47808.  You may attend the hearing if you wish.  One of the purposes of the hearing is to permit you to express your views concerning the proposed plans.  Please send any comments or objections you may have to either or both plans in a letter or e-mail to the court.  To be considered by the court, any letter or e-mail must be received by the Court Clerk no later than July 9, 2007. Letters should be sent to the Clerk of the U.S. District Court, 46 East Ohio Street, Room 105, Indianapolis, IN 46204, with copies to the Receiver at 251 East Ohio Street, Room 1100, Indianapolis, IN 46204, and to the Bondholder Committee at 524 Chuck Wagon, Mustang, OK 73064.  E-mails should be sent to the Clerk of the U.S. District Court at sec-alanar@insd.uscourts.gov, with copies to the Receiver at receiver@silegal.com and to the intervening bondholders at robtbolton@msn.com .  Letters or e-mails must be received by the deadline to be considered.

The plans are not subject to a vote or approval by the bond issuers or bondholders.  A plan can be imposed only by the court’s ruling.  The proposed plans will be reviewed by the Judge, who, based on the evidence presented at the hearing and the comments received by the deadline, will determine the disposition of the assets of the Receivership.

Please note that neither the Receiver, the intervening bondholders, the Securities and Exchange Commission, nor the court are your legal representatives.  You should consult your own attorney or advisor regarding this matter.
